Terms Of Use Agreement

This document constitutes a legally binding agreement between you, whether as an individual or representing an entity ("you" or "your"), and TemplatesGo, a SAAS website managed, operated, and owned by FOTOEFECTOS TECHNOLOGIES SL, a Spanish company with identification number B65711780, registered at C Francesc Layret 82, Cornella de Llobregat – Barcelona, Spain (referred to collectively as the "Company," "we," "us," or "our"). This agreement pertains to your access to and use of the https://templatesgo.com/ website, as well as any other media form, media channel, mobile website related, linked, or otherwise connected to it (collectively referred to as the "Site," "Website," or "Service").

By utilizing our site, all parties willingly acknowledge that they have read, fully understood and agree to the Terms and Conditions that have been outlined in the agreement. IF YOU DO NOT CONSENT TO ANY CONDITIONS STIPULATED IN THE TERMS OF USE, YOU ARE PROHIBITED FROM USING THE SITE OF TEMPLATESGO AND SHOULD DESIST USE IMMEDIATELY. 

Any additional T&Cs or documents which will be occasionally posted on the Site have been unmistakably integrated into the Terms of Use Agreement by reference. TemplatesGo reserves the right to implement any changes or adjustments to these Terms of Use at any point in time and for reasons best known to TemplatesGo. If any changes have been implemented to the Terms of Use Agreement, every user of the site will be informed in due time through the “Last updated date section” which can be found on the Terms of Use Agreement. It is the responsibility of the users to review these terms for updates periodically. Your continued use of the Site after the posting of revised Terms of Use Agreement will be deemed acceptance of those changes.

All the information posted on TemplatesGo is not intended for the purpose of distribution or use in any other jurisdiction or country where such distribution or use would be deemed as a contradiction to the laws and regulations, or which would subject TemplatesGo to any registration requirement within such jurisdiction or country. Those who which to access the Site from other locations apart from TemplatesGo operational jurisdiction, do so at their own free will and are solely responsible for compliance with applicable local laws. 

It is important to note that TemplatesGo is not a law firm or practicing attorneys and does not engage in any law practices. Furthermore, TemplatesGo cannot and does not offer users or clients any legal advice or representation. All information, software, and services provided on the Site is only intended for informational purposes and self-help, and is not intended to replace the guidance of a lawyer or professional legal advice.

This Site is not intended for or designed to cooperate with any industry-specific regulations (such as HIPAA, FISMA, etc.). If your interactions fall under such laws, further use of this site is prohibited. In addition, usage violating the Gramm-Leach-Bliley Act (GLBA) is completely restricted. This site is only intended for users who are 16 or older. All users who are minors in their jurisdiction (generally under the age of 18) must have the permission and direct supervision of their parent or guardian to use the Site. If you are a minor, your parent or guardian must read and agree to these Terms of Use before you can use the Site.

INTELLECTUAL PROPERTY RIGHTS

Unless otherwise indicated, the Site and all its elements, including source code, databases, functionality, software, website designs, audio, video, text, photographs, and graphics (collectively, the "Content"), as well as the trademarks, service marks, and logos (the "Marks"), are either owned or controlled by us, or licensed to us. Subject to your eligibility to use the Site, you are granted a limited license to access and use the Site and to download or print a copy of any portion of the Content to which you have properly gained access solely for your personal, non-commercial use. TemplatesGo reserves all rights not expressly granted to you in and to the Site, the Content, and the Marks.

USER AGREEMENTS

By using the Site, you agree and authorize that:

  • All registration information which you have given to us is correct, honest, complete and updated. 
  • You will keep the information accurate and quickly update it as necessary.
  • You have the legal capability and agree to adhere to these Terms of Use.
  • You are aged 16 and over. 
  • You are not considered a minor in your current jurisdiction, or if a you are minor, you have received parental permission to use the Site.
  • You will not gain access to the Site using automated or non-human means, whether through a bot, script, or any other means which are considered automated. .
  • You will not use the Site for any prohibited or unlawful purposes. 
  • Your use of the Site will not breach any applicable law or regulation.
  • Providing any information that is untrue, inaccurate, undated, or incomplete gives us the right to suspend or terminate your account and refuse any and all current or future use of the Site (or any portion thereof).

USER REGISTRATION

You may be required to register using personal information in order to use the Site, you therefore agree that it is your responsibility to keep your password confidential by not sharing your password or any other users details with any other individual, user or non user of the Site. You are responsible for protecting your user account and password. We reserve the right to remove, reclaim, or change a username if we determine, in our sole discretion, that such username is inappropriate, obscene, or otherwise objectionable.

RELATIONSHIP BETWEEN THE USER AND YOUR RESPONDENTS

TemplatesGo, has explicitly stated that we are not a party to any contractual relationship between you and your customers or form respondents, collectively referred to as "Your Respondents." Your responsibilities contain various aspects of this relationship:

Contractual Arrangements: 

You are solely responsible for entering into suitable contractual arrangements with Your Respondents.

Product and Service Provision: 

The provision of products or services, as well as honoring any bookings made through our Services, falls entirely under your scope. 

Payment and Refunds: 

The user is solely responsible for collecting any related payments and making all arrangements for refunds, if applicable, in the course of your dealings with Your Respondents.

Personal Information Awareness: 

It is crucial to make sure that all Your Respondents have been made aware that their personal information may be provided to and processed through our Services, as TemplatesGo will not be legally responsible if this information was not duly commutated to Your Respondents. This includes obtaining all necessary consents and authorizations for such usage.

Moreover, you explicitly represent, warrant, and covenant that:

Compliance with Privacy Laws:

Your creation, collection, receipt, access, use, storage, disposal, and disclosure of data and/or information from Your Respondents will consistently comply with all applicable federal, state, and international privacy and data protection laws, rules, regulations, and directives.

Legal Data Provision:

You will not provide TemplatesGo with any data and/or information that violates any applicable laws, rules, regulations, or directives.

Privacy Policy Adherence:

You commit to treating Your Respondent data and/or information in accordance with our Privacy Policy.

This depiction establishes the boundaries of our involvement and underscores your sole responsibility for the management of relationships with Your Respondents.

FEES AND PAYMENT

In instances where we provide paid products and/or services within the Service, we may engage third-party services for payment processing, such as payment processors. Your payment card details are not stored or collected by us; instead, this information is directly provided to our third-party payment processors. We accept various forms of payment, including: Visa - American Express – MasterCard and Discover.

To access certain services, you may be required to make a purchase or pay a fee. By doing so, you agree to provide current, complete, and accurate purchase and account information for all transactions conducted via the Site. Furthermore, you commit to promptly update account and payment information, including email address, payment method, and payment card expiration date, to facilitate the completion of transactions and necessary communication. Online billing accounts are used to bill you for purchases made via the Site. Sales tax, as determined by us, will be added to the purchase price. Prices are subject to change at our discretion. All payments shall be made in U.S. dollars and € EUR.

By agreeing to these terms, you authorize us to charge your chosen payment provider for the applicable amounts when making a purchase. If your purchase incurs recurring charges, you consent to TemplatesGo charging your payment method on a recurring basis without the need for prior approval for each recurring charge unless you notify TemplatesGo that you want to cancel your subscription. TemplatesGo retains the right to rectify any errors or mistakes in pricing, even after payment has been requested or received. Additionally, TemplatesGo reserves the right to decline any order placed through the Site.

CANCELLATION

You have the option to cancel your subscription at any time by logging into your account or by reaching out to us using the contact information provided below. The cancellation becomes effective at the end of the current paid term. If you find our services unsatisfactory, please communicate via email at contact@templatesgo.com.

PROHIBITED ACTIVITIES

You may not access or use the Site for any purpose other than that for which we make the Site available. The Site may not be used in connection with any commercial endeavours except those that are specifically endorsed or approved by TemplatesGo.

As a user of the Site, you agree not to:

Misrepresentation: Misrepresent yourself or disguise the origin of any content.

Engage in activities such as "spoofing," "phishing," manipulating headers or other identifiers, impersonating anyone else, or falsely implying any sponsorship or association with TemplatesGo or any third party.

Use of Services: 

  • Use the Services to collect sensitive information from others without enabling security features on the Site (SSL, PGP, and data encryption).
  • Use the Services for the purpose of providing alerts on disaster scenarios or any other situations directly related to health or safety, including but not limited to acts of terrorism, natural disasters, or emergency response.
  • Use the services to generate or send unsolicited communications, advertising, chain letters, or spam.

Message Headers and Information: Forge, misrepresent, omit, or delete message headers, return mailing information, and/or Internet protocol addresses to conceal or misidentify the origin of a message.

Intellectual Property Rights: Infringe the intellectual property or other rights of TemplatesGo or others, including any copyright, trademark, patent, trade secret, moral rights, privacy rights of publicity, any other intellectual property right, proprietary or contractual right.

Data Retrieval and Unauthorized Use: Systematically retrieve data or other content from the Site to create or compile, directly or indirectly, a collection, compilation, database, or directory without written permission from TemplatesGo.

Make any unauthorized use of the Site, including collecting usernames and/or email addresses of users by electronic or other means for the purpose of sending unsolicited email, or creating user accounts by automated means or under false pretences.

Use in Violation of Laws or Regulations: Use the Site in a manner inconsistent with any applicable laws or regulations.

Disparagement and Harm: Disparage, tarnish, or otherwise harm, in our opinion, us and/or the Site.

Commercial Activities: Use a buying agent or purchasing agent to make purchases on the Site. Use the Site to advertise or offer to sell goods and services.

Security Interference: Circumvent, disable, or otherwise interfere with security-related features of the Site, including features that prevent or restrict the use or copying of any Content or enforce limitations on the use of the Site and/or the Content contained therein. Engage in unauthorized framing of or linking to the Site.

Deceptive Practices: Trick, defraud, or mislead TemplatesGo and other users, especially in any attempt to learn sensitive account information such as user passwords. Make improper use of our support services or submit false reports of abuse or misconduct.

Automated Use and Interference: Engage in any automated use of the system, such as using scripts to send comments or messages, or using any data mining, robots, or similar data gathering and extraction tools.Interfere with, disrupt, or create an undue burden on the Site or the networks or services connected to the Site.

Impersonation and Profile Transfer: Attempt to impersonate another user or person. Sell or otherwise transfer your profile.

Harassment and Misuse: Use any information obtained from the Site in order to harass, abuse, or harm another person.

Software Modification and Bypass: Decipher, decompile, disassemble, or reverse engineer any of the software comprising or in any way making up a part of the Site.

Use for Revenue-Generating Endeavors: Use the Site as part of any effort to compete with TemplatesGo or otherwise use the Site and/or the Content for any revenue-generating endeavor or commercial enterprise.

Access Bypass and Threats: Attempt to bypass any measures of the Site designed to prevent or restrict access to the Site, or any portion of the Site.

Harass, annoy, intimidate, or threaten any of our employees or agents engaged in providing any portion of the Site to you.

Copyright and Software: Delete the copyright or other proprietary rights notice from any Content.

Copy or adapt the Site’s software, including but not limited to Flash, PHP, HTML, JavaScript, or other code.

Malicious Uploads and Information Collection: Upload or transmit (or attempt to upload or to transmit) viruses, Trojan horses, or other material, including excessive use of capital letters and spamming (continuous posting of repetitive text), that interferes with any party’s uninterrupted use and enjoyment of the Site or modifies, impairs, disrupts, alters, or interferes with the use, features, functions, operation, or maintenance of the Site.

Upload or transmit (or attempt to upload or to transmit) any material that acts as a passive or active information collection or transmission mechanism, including without limitation, clear graphics interchange formats (“gifs”), 1×1 pixels, web bugs, cookies, or other similar devices (sometimes referred to as “spyware” or “passive collection mechanisms” or “pcms”).

Except as may be the result of standard search engine or Internet browser usage, use, launch, develop, or distribute any automated system, including without limitation, any spider, robot, cheat utility, scraper, or offline reader that accesses the Site, or using or launching any unauthorized script or other software.

USER-GENERATED CONTENT AND CONTRIBUTIONS

USER-GENERATED CONTENT

The Site provides you with the ability to generate and customize content, including but not limited to text, data, articles, images, photographs, graphics, software, applications, designs, features, and other materials ("Content"). The Site user is solely responsible for any content that they post during the customization process of any templates. The user is therefore responsible for any links, uploads or post and any other information made available by the user on the Site, irrespective of the harm which may be a direct result of this. TemplatesGo does not assume responsibility for any public display or misuse of your Content. Additionally, you agree to the following terms:

  • TemplatesGo reserves the right to remove any Content, as per TemplatesGo discretion and we are permitted by law to this without prior information to the user. While TemplatesGo does not pre-screen Content, we retain the right (though not the obligation) to refuse or remove any Content from the Site which has violated any of our Terms and Conditions or policies.
  • In accordance to the ownership of Content, Right to Post, and License Grants. The user maintains ownership and responsibility for their individual Content. If a user posts or uses anything which has not been created by the user or lacks the necessary rights, the user of the Site agree to take responsibility for such Content. It imperative to note that by using our Site, the user grants TemplatesGo its legal successors a nonexclusive, worldwide, royalty-free right to use, copy, reproduce, display, modify, adapt, distribute, and perform your Content to other renders of the Site.

USER-GENERATED CONTRIBUTIONS

The Site may invite users to engage in activities such as chatting, contributing to blogs, message boards, online forums, and other functionalities, allowing users to create, submit, post, display, transmit, perform, publish, distribute, or broadcast content and materials to us on the Site, collectively referred to as "Contributions." These Contributions may be viewable by other users and through TemplatesGo third-party websites, treating any transmitted Contributions as non-confidential and non-proprietary. By creating or making available any Contributions, the users assert and assure the following:

  • The creation, distribution, transmission, public display, or performance of your Contributions does not infringe the proprietary rights of any third party.
  • The user owns or has the necessary licenses, rights, consents, releases, and permissions for the use of your Contributions by TemplatesGo, the Site, and other users.
  • The user has written consent, releases, and/or permission to use the name or likeness of identifiable individuals in their Contributions in any manner contemplated by the Site and these Terms of Use.
  • The user’s Contributions are accurate, not misleading, and comply with applicable laws.
  • The user’s Contributions adhere to various standards outlined, including refraining from false advertising, obscenity, harassment, violation of privacy rights, and other prohibited content. Any use of the Site in violation of these standards may result in the termination or suspension of your rights to use the Site.
  • The user’s Contributions do not violate the privacy or publicity rights of any third party.
  • The user’s Contributions do not contain material that solicits personal information from individuals under the age of 18 or exploits people under the age of 18 in a sexual or violent manner.
  • The user’s Contributions do not violate any applicable law concerning child pornography or are intended to protect the health or well-being of minors.
  • The user’s Contributions do not include offensive comments connected to race, national origin, gender, sexual preference, or physical handicap.
  • The user’s Contributions does not violate and is not linked to material that violates any provision of these Terms of Use or any applicable law or regulation.

Any use of the Site in violation of the above terms and conditions constitutes a breach of these Terms of Use and may result in, among other consequences, the termination or suspension of your rights to use the Site.

CONTRIBUTION LICENSE

By submitting Contributions to any part of the Site, the users automatically grants, affirm and warrant that they possess the right to grant to TemplatesGo an unrestricted, unlimited, irrevocable, perpetual, non-exclusive, transferable, royalty-free, fully-paid, global right, and license. This license enables TemplatesGo to host, use, copy, reproduce, disclose, sell, resell, publish, broadcast, retitle, archive, store, cache, publicly perform, publicly display, reformat, translate, transmit, excerpt (in whole or in part), and distribute such Contributions, including, without limitation, the user’s image and voice, for any purpose, be it commercial, advertising, or otherwise. Additionally, the user grants us the authority to create derivative works from, or incorporate into other works, such as Contributions, and authorize sublicenses of the aforementioned rights. The utilization and distribution may take place in any media formats and through any media channels.

This license is applicable to any form, media, or technology currently known or developed in the future. It includes TemplatesGo use of the user's name, company name, franchise name, as applicable, and any trademarks, service marks, trade names, logos, and personal and commercial images you provide. The users expressly waive all moral rights associated with the user’s Contributions, affirming that no moral rights have been asserted in the user’s Contributions.

We do not claim ownership over your Contributions. The user retains complete ownership of all the user’s Contributions and any intellectual property rights or other proprietary rights linked to the user’s Contributions. We bear no responsibility for statements or representations in the user’s Contributions provided by the user on any section of the Site. The user is solely responsible for the user’s Contributions to the Site, and the user explicitly agrees to absolve TemplatesGo from any and all responsibility and to refrain from initiating legal action against TemplatesGo concerning the user’s Contributions.

In our sole and absolute discretion, TemplatesGo reserves the right:

  • To edit, redact, or otherwise modify any Contributions.
  • To re-categorize Contributions for placement in more appropriate locations on the Site.
  • To pre-screen or delete Contributions at any time and for any reason, without prior notice. TemplatesGo is not obligated to monitor your Contributions.

GUIDELINES FOR REVIEWS

TemplatesGo may provide the user with areas on the Site to leave reviews or ratings. When posting a review, the user must comply with the following criteria: 

Firsthand Experience: Reviews must be based on firsthand experiences with the person or entity under consideration.

Language and Tone: Reviews should refrain from containing offensive profanity, abusive language, racism, hate speech, or any form of offensive language.

Non-discrimination: Reviews must avoid discriminatory references based on religion, race, gender, national origin, age, marital status, sexual orientation, or disability.

Avoid Illegal References: Reviews should not make references to illegal activities.

Non-affiliation with Competitors: If posting negative reviews, reviewers should not be affiliated with competitors.

Legal Conclusions: Conclusions regarding the legality of conduct should not be made in reviews.

Accuracy: Reviews must not contain false or misleading statements.

Campaign Prohibition: Organizing campaigns to encourage others to post reviews, whether positive or negative, is strictly prohibited.

The acceptance, rejection, or removal of reviews rests solely at our discretion. TemplatesGo holds no obligation to screen or delete reviews, even if deemed objectionable or inaccurate by any party. Reviews are not endorsed by TemplatesGo, and they may not necessarily reflect our opinions or the views of our affiliates or partners. TemplatesGo disclaims liability for any review and any associated claims, liabilities, or losses. By posting a review, the user grants TemplatesGo a perpetual, non-exclusive, worldwide, royalty-free, fully paid, assignable, and sublicensable right and license to reproduce, modify, translate, transmit, display, perform, and distribute all content related to the reviews.

SUBMISSIONS

By providing any questions, comments, suggestions, ideas, feedback, or other information regarding the Site ("Submissions"), the user acknowledges and agrees that:

Non-confidentiality: Submissions are non-confidential and become TemplatesGo’s sole property.

Ownership and Use: TemplatesGo owns exclusive rights, including all intellectual property rights, and has the right to use and disseminate Submissions for any lawful purpose, commercial or otherwise, without acknowledgment or compensation to the user. 

Waiver of Moral Rights: The user waives all moral rights to any Submissions, warranting that they are original or that the user has the right to submit them.

No Recourse Against Us: There shall be no recourse against TemplatesGo for alleged or actual infringement or misappropriation of any proprietary right in the user’s Submissions.

SITE MANAGEMENT

TemplatesGo retains the right, though not the obligation, to:

Monitoring and Enforcement: Monitor the Site for violations of these Terms of Use.

Legal Action: Take appropriate legal action against anyone, at our sole discretion, who violates the law or these Terms of Use. This may include reporting such users to law enforcement authorities.

Access Restriction: In our sole discretion and without limitation, refuse, restrict access to, limit the availability of, or disable (to the extent technologically feasible) any of the user’s Contributions or any portion thereof.

Content Removal: In our sole discretion and without limitation, notice, or liability, remove from the Site or otherwise disable all files and content that are excessive in size or burdensome to our systems.

Site Management: Otherwise manage the Site to protect our rights and property and facilitate its proper functioning.

PRIVACY POLICY

We prioritize data privacy and security. Please review our Privacy Policy at the https://templatesgo.com/privacy-policy/. By using the Site, you agree to be bound by our Privacy Policy, which is incorporated into these Terms of Use. The Site is hosted in the United States, and if you access it from another region with different data privacy laws, you agree to the transfer and processing of your data in the United States. Furthermore, we do not knowingly collect information from or market it to children. In compliance with the U.S. Children’s Online Privacy Protection Act, if we learn that a person under 16 has provided personal information without parental consent, we will promptly delete such information.

TERM AND TERMINATION

These Terms of Use are effective during your use of the Site. Without limiting other provisions, TemplatesGo reserves the right, without notice or liability, to deny access and use of the Site (including blocking certain IP addresses) for any reason, including a breach of these Terms or any applicable law.

TemplatesGo may terminate your use or participation in the Site, delete your account, and remove any posted content or information without warning, in our sole discretion. If your account is terminated or suspended, you are prohibited from creating a new account under any name, including a fake or borrowed one or that of any third party. In addition to termination or suspension, we reserve the right to take appropriate legal action, including civil, criminal, and injunctive measures.

MODIFICATIONS AND INTERRUPTIONS

TemplatesGo retains the right to change, modify, or remove Site contents at our sole discretion without notice. We are not obligated to update information on the Site. We may also modify or discontinue all or part of the Site without notice, and we will not be liable for any consequences arising from such modifications, price changes, suspensions, or discontinuances. The Site's availability is not guaranteed, and interruptions, delays, or errors may occur due to hardware, software, or maintenance issues. We reserve the right to change, revise, update, suspend, discontinue, or modify the Site without notice, and we bear no liability for any loss, damage, or inconvenience resulting from your inability to access or use the Site during downtime or discontinuance. These Terms of Use do not obligate us to maintain or support the Site or supply any corrections, updates, or releases.

SITE CORRECTIONS

The Site may contain information with typographical errors, inaccuracies, or omissions, including descriptions, pricing, and availability. We reserve the right to correct such errors, inaccuracies, or omissions and to change or update information on the Site without prior notice

TEMPLATESGO MAKES NO WARRANTIES OR REPRESENTATIONS ABOUT THE ACCURACY OR COMPLETENESS OF THE SITE’S CONTENT OR LINKED WEBSITES AND ASSUME NO LIABILITY FOR (1) ERRORS, MISTAKES, OR INACCURACIES; (2) PERSONAL INJURY OR PROPERTY DAMAGE RESULTING FROM YOUR ACCESS TO AND USE OF THE SITE; (3) UNAUTHORIZED ACCESS TO OR USE OF OUR SECURE SERVERS AND/OR PERSONAL/FINANCIAL INFORMATION; (4) INTERRUPTION OR CESSATION OF TRANSMISSION TO OR FROM THE SITE; (5) BUGS, VIRUSES, OR THE LIKE TRANSMITTED BY THIRD PARTIES; AND/OR (6) ERRORS OR OMISSIONS IN ANY CONTENT/MATERIALS OR FOR ANY LOSS OR DAMAGE INCURRED DUE TO THE USE OF POSTED CONTENT ON THE SITE.

WE DO NOT WARRANT, ENDORSE, GUARANTEE, OR ASSUME RESPONSIBILITY FOR ANY PRODUCT OR SERVICE ADVERTISED OR OFFERED BY A THIRD PARTY THROUGH THE SITE. WE ARE NOT RESPONSIBLE FOR MONITORING TRANSACTIONS BETWEEN YOU AND THIRD-PARTY PROVIDERS. USE YOUR BEST JUDGMENT AND EXERCISE CAUTION WHEN PURCHASING PRODUCTS OR SERVICES THROUGH ANY MEDIUM OR ENVIRONMENT.

LIMITATIONS OF LIABILITY
